HOW TO GET YOUR RECORDS ON
GUILTY PLEAS/BLIND PLEAS/NOLO CONTENDERE OR "NO CONTEST" PLEAS
To get the court records regarding your plea and sentencing
procedures you must write a letter to the Court Clerk of the
District Court in the County in which your received your sentence
and request a copy of the following documents:
(1) Felony Information Sheets, to include any 2nd Page listing
Prior Felony Convictions;
(2) Judgment and Sentence;
(3) Summary Of Facts - On Guilty Plea/Blind Plea/or
Nolo Contenders Plea;
(4) Criminal Docket Sheets.
In your letter to the Court Clerk you must give your name and
the case number of the documents your interested in.
Address a stamped envelope to the Court Clerk of the court
in which you received your sentence. (You can get the name and
address of the Court Clerk from the law library by filling out a
"Request To Staff"). DO NOT SEAL THE ENVELOPE.
Once you have written the letter, place it into the unsealed
envelope and contact your case manager to inform him or her that
you wish to send a $15.00 Check to the Court Clerk for the legal
documents you have requested in your letter. (UNLESS YOU PLEAD
GUILTY TO A NUMBER OF DIFFERENT CASE NUMBERS IN A SINGLE
PROCEEDING, IT WILL COST YOU APPROXIMATELY $15.00 PER CASE NUMBER
TO GET THE ABOVE MENTIONED DOCUMENTS .
DO NOT SEND ANY MONEY UNTIL THEY TELL YOU HOW MUCH TO SEND.
SOMETIMES YOU CAN GET IT FREE.
PLEASE NOTE: THAT UNLESS YOUR TRIAL ATTORNEY FILED THE
NECESSARY DOCUMENTS TO INITIATE AN APPEAL IN YOUR CASE THERE ARE
NO TRIAL TRANSCRIPTS OF YOUR PLEA AND SENTENCING PROCEEDINGS. AS
A GENERAL RULE, TRANSCRIPTS ARE MADE ONLY AFTER AN APPEAL HAS
BEEN REQUESTED AND ONLY AFTER YOUR TRIAL ATTORNEY HAS FILED THE
REQUIRED "NOTICE OF INTENT TO APPEAL AND DESIGNATION OF RECORDS"
IN YOUR CASE. THUS, IF NO APPEAL WAS FILED IN YOUR CASE THE
ABOVE MENTION DOCUMENTS ARE PRETTY MUCH ALL OF THE RECORDS YOU
CAN EXPECT TO RECEIVE IN YOUR CASE AT THIS POINT IN TIME.
